Section 1: Sale of Goods

1.1 Acceptance of Terms - By placing an order on our website or purchasing goods from us, you agree to be bound by these Terms and Conditions.

1.2 Product Information - We strive to provide accurate product information. However, we reserve the right to make changes to product descriptions, pricing, and availability without notice.

1.3 Ordering and Payment

  • Orders are subject to acceptance by us.

  • Ownership: Ownership of all goods remains with us until full payment has been received.

1.4 Shipping and Delivery

  • We will use reasonable efforts to deliver your order on time.

  • Shipping costs may apply and will be agreed upon at the time of purchase.

  • Risk of loss or damage to goods passes to you upon delivery.

1.5 Returns and Refunds

  • We offer a 14-day return window for change of mind goods. 

  • Buyer must notify us within 7 days of delivery if they have received incorrect items.

  • Refunds will be processed within 7 business days after completion of investigation and will be done in the same mode of payment as that of the purchase order.

  • For Change of Mind cases, shipping costs for returns are the customer’s responsibility.

1.6 Limitation of Liability

  • Our liability for any loss or damage, whether direct or indirect, is limited to the value of the goods.

  • We are not liable for any loss of profits, business interruption, or other consequential damages.

1.7 Intellectual Property - All intellectual property rights, including trademarks, copyrights, and patents, associated with our products and services are owned by us or our licensors.  

1.8 Privacy - We collect and use your personal information in accordance with our Privacy Policy. This includes collecting data through cookies and other tracking technologies to enhance your user experience and for marketing purposes.

1.9 Governing Law and Jurisdiction - These Terms and Conditions are governed by the laws of New Zealand. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the New Zealand courts.

Section 2: Service Terms

2.1 Service Provision - We will provide services to you in accordance with the terms of our agreement.

  • Installation: We will install products or equipment as specified in the agreement.

  • Maintenance and Repair: We will provide maintenance and repair services as agreed in written for a particular time-period.

  • Other Services: We may provide other services, such as removal, recycling, consulting or training.

2.2 Payment - Payment terms for services will be agreed upon in writing.

2.3 Service Level Agreements - We may provide specific Service Level Agreements (SLAs) outlining service performance metrics and response times.

2.4 Limitation of Liability - Our liability for any loss or damage, whether direct or indirect, is limited to the value of the services provided. We are not liable for any loss of profits, business interruption, or other consequential damages. 

2.5 Intellectual Property - All intellectual property rights, including trademarks, copyrights, and patents, associated with our services are owned by us or our licensors.  

2.6 Confidentiality -  We may have access to confidential information. We will keep such information confidential and use it only for the purpose of providing our services.

Section 3: Equipment Hire

3.1 Hire Agreement - A hire agreement is formed when you accept a hire schedule issued by us.

3.2 Hire Charges - Payment terms for equipment hire will be agreed upon in writing.

  • Ownership: Ownership of the equipment remains with us at all times unless equipment is sold as goods & full invoiced payment is received.

3.3 Equipment Use and Care

  • You must use the equipment in accordance with its intended purpose and any instructions provided by us.

  • You are responsible for the safekeeping and maintenance of the equipment. Any inspection or maintenance from our end will be agreed in writing.

3.4 Damage and Loss - You are responsible for any damage or loss to the equipment, unless caused by our negligence.

3.5 Return of Equipment - The equipment must be returned to us in good & acceptable condition and on the agreed-upon date.

3.6 Insurance -  You may be required to have insurance coverage for the equipment while it is in your possession. In such a case, all terms will be agreed in writing.

3.7 Governing Law and Jurisdiction - These terms for equipment hire are governed by the laws of New Zealand. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the New Zealand courts.
